Welcome to Breeza (“Breeza,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of https://breezabeachwear.com and any related services, features, or content (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1) Eligibility & Account
You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases or submit information on the Site. You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.
2) Purchases, Pricing, and Availability
Prices, promotions, product descriptions, and availability may change without notice. We reserve the right to refuse or cancel any order at our discretion (for example, suspected fraud, apparent errors, or product unavailability). If we cancel an order after your payment has been processed, we will issue a refund to your original payment method.
Shipping, returns, and exchanges are governed by our store policies posted on the Site (see “Returns/Exchanges” or similar page). Please review those policies before purchase.
3) Store Information & Locator
The Site may display information about our physical locations (e.g., addresses, phone numbers, business hours) through our store locator. While we strive for accuracy, hours and availability can change (including holidays and special events). We encourage you to call the store to confirm details before visiting.
4) Content & Intellectual Property
All content on the Site—including text, graphics, logos, images, videos, design, and software—is owned by Breeza or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, display, sell, or create derivative works from any Site content without our prior written consent.
Any feedback, ideas, or suggestions you submit may be used by Breeza without restriction or compensation.
5) Acceptable Use
You agree not to:
- Use the Site for unlawful, harmful, or abusive purposes;
- Probe, scan, or test the vulnerability of the Site or circumvent security;
- Use automated means (scrapers, bots) to access or copy Site content without permission;
- Interfere with or disrupt the operation of the Site or others’ use of it.
6) Third-Party Services
The Site may link to third-party services or content (e.g., Google Maps, Vimeo, social platforms, payment processors). We are not responsible for third-party sites or services, their content, or their privacy/security practices. Your use of third-party services is governed by their terms and policies.
7) Analytics, Cookies & Google APIs

We also maintain accurate store information by synchronizing business hours from Google Business Profile via Google’s API Services. To the fullest extent permitted by law, Breeza disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.
9) Limitation of Liability
To the fullest extent permitted by law, Breeza and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Site or any products/services purchased through it. In no event will Breeza’s total liability exceed the amount you paid to Breeza for the product or service at issue, or one hundred U.S. dollars (US$100), whichever is greater.
10) Indemnification
You agree to defend, indemnify, and hold harmless Breeza and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site.
11) Changes to the Site or Terms
We may modify or discontinue the Site (in whole or in part) at any time without notice. We may also update these Terms from time to time. The “Effective Date” above reflects the most recent version. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
12) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction and venue.
Class Action Waiver: To the fullest extent permitted by law, you and Breeza agree that any claims will be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
13) Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to Breeza, other users, or third parties.
